TERMS AND CONDITIONS 

Thank you for choosing EmPowered STEM! We are excited to have you as a valued student.  Before you finalise your purchase and embark on an enriching learning journey with us, we  kindly ask you to review and accept the following terms and conditions ("Agreement"). These  terms govern the use of services provided through our website empowermind.co.uk  ("Website"). 

By accepting these terms and conditions, you acknowledge that you have read, understood, and  agreed to be bound by the terms outlined herein. We encourage you to carefully review the  terms and course details and reach out to us if you have any questions or concerns. Your  satisfaction and success in your educational endeavours are of utmost importance to us. 

  1. DEFINITIONS 

(a) “Courses” refers to the educational courses listed on the Website. 

(b) “Course Fees” refers to the amounts that are due and payable by the Student at the time  of enrolment. 

(c) “EmPowered STEM”, “Company” or “We” refers to the EmPowerMind Evolved Ltd. 

(d) “Student” refers to a member who enrols for Courses on the Website, in the case of a  minor student the parent or guardian who enrols their child or ward for the Courses on  Site. 

(e) “Tutor” refers to a member who has been selected by EmPowered STEM in order to  provide services on behalf of Company. 

(f) “Tutoring Services” refers to the educational support and guidance provided by Tutor  to Student through electronic means, utilising internet-based communication tools and  virtual learning platforms. 

  1. ACCEPTANCE OF TERMS 

2.1. By purchasing any courses offered by EmPowered STEM, the Student acknowledges and  agrees to be bound by these Terms and Conditions.

2.2. If the Student does not agree with any part of these Terms and Conditions, they should  not access or use the Website or purchase any courses. 

  1. ELIGIBILITY 

3.1. You must be at least 18 years old to enrol in our Courses. If you are under 18 years of  age, you may use our services only in conjunction with and under the supervision of a  parent, legal guardian, or an appropriate person aged 18 or over. 

3.2. If you are under 18 years of age, you may access the Platform, provided that any billed  services are guaranteed by a person of 18 years or older, and the bill-paying account is  held in their name. 

  1. COURSE ENROLLMENT  

4.1. EmPowered STEM offers different courses as full packages on the Website. Student can  conveniently purchase these courses and enrol in the program. 

4.2. The course details, including the course outline and price, will be visible on the Website  before you proceed with the checkout and payment process. We encourage you to  thoroughly review the course details before enrolling to ensure they align with your  expectations and requirements. 

4.3. Please note that once you have successfully enrolled in a specific program and completed  the payment, it is not possible to request a transfer or switch to a different program. 

  1. FEE AND PAYMENT 

5.1. Payment can be made through Debit/ Credit Card, PayPal, or any other mode available  on the Website. 

5.2. In case of payment in the mode of instalment, the Student must notify the EmPowered  STEM of any change to its billing information at least five (5) business days prior to the  payment due date. 

5.3. The course fee is subject to change at any time at the EmPowered STEM's sole discretion,  however, any such change will not apply to the Course Fee in which the Student is  presently enrolled.

5.4. The Course Fee shown on the Website is exclusive of Bank transfer fees, customs  charges, import duty, value-added tax and/or local sales taxes.  

5.5. Payment is due when it is expected as per the payment schedule. If payment is not made  before the due date, the Tutoring Services may be suspended until the payment in arrears  is made up. 

  1. REFUND AND CHARGEBACKS 

6.1. Except as expressly provided herein, all payments under this Agreement will be  irrevocable, non-refundable, and non-creditable under any circumstances, including  termination of this Agreement for any reason. 

6.2. The payment method information supplied by the Student to the EmPowered STEM may  be utilised by the EmPowered STEM to settle any payment due on the agreed dates. 

6.3. If the Student disputes any amount or charges payable to the EmPowered STEM, the  Student shall notify the disputed amount to EmPowered STEM, and both parties should  make reasonable efforts to resolve the dispute through good faith negotiations. The  Student shall not make any chargebacks to the EmPowered STEM's account or cancel  the credit card provided as security without the EmPowered STEM's prior written  consent. 

6.4. Any charges incurred by the EmPowered STEM for collecting losses due to chargebacks and any related collection costs shall be the Student’s responsibility. Any updates or  changes to the billing information submitted by the Student to the EmPowered STEM without prior notification constitute a violation of this Agreement. 

  1. CANCELLATION POLICY 

Once the Student has enrolled in a program and has paid the fee, he/she will not be able  to cancel the transaction under any circumstances. No Payment will be refunded to the  Student. 

  1. ACKNOWLEDGEMENT BY STUDENT

8.1. The Student's access to the recordings and class materials provided by the EmPowered  STEM depends on the Course enrolled by the Student at the start of the Agreement and  the payment of applicable fees for the same. 

8.2. The EmPowered STEM does not provide makeup or complementary sessions for any  classes missed by the Student due to the Student's act or omission. In such cases, the  Student is expected to watch the recorded classes to catch up on missed sessions. 

8.3. The Student acknowledges that unforeseen events may occur, which can prevent the  Tutor from delivering a live class session. In such an event, the Tutor will make  reasonable efforts to record and upload the missed lesson through the Kajabi Portal  provided to the Student as soon as possible. 

8.4. The login information provided to access the Course, recordings, or any other  deliverables as part of this Agreement should not be shared by the Student with any third  party. In the event of unauthorised sharing, the EmPowered STEM reserves the right to  cancel the Student's access to the Course, and no subsequent refunds will be provided. 

8.5. By participating in EmPowered STEM courses, you grant the EmPowered STEM the  right to use any media, including photographs, videos, or recordings, taken during the  course for promotional purposes. The EmPowered STEM may use such media without  disclosing the Student's name or personal information. 

  1. INTELLECTUAL PROPERTY RIGHTS 

9.1. All content provided in the courses, including but not limited to text, images, videos, and  course materials, are the intellectual property of the EmPowered STEM and are protected  by copyright laws. 

9.2. The Student undertakes to only use the course content for individual use and agrees not  to reproduce, distribute, modify, or create derivative works from the course content  without prior written consent from the EmPowered STEM. Reproduction or distribution  of course content is strictly prohibited. 

  1. MODIFICATION OF COURSE

EmPowered STEM reserves the right to modify or update course content and materials  as needed. Students acknowledge that course modifications may occur and agree to adapt  to such changes. EmPowered STEM will make reasonable efforts to notify students of  any significant modifications or discontinuations. No refunds or compensation will be  provided due to course modifications. 

  1. TUTOR AVAILABILITY 

11.1. EmPowered STEM strives to provide qualified and experienced tutors for its courses. 

11.2. However, the EmPowered STEM does not guarantee the availability of a specific tutor  for any given course. Tutor assignments are subject to availability and may change based on various factors, including scheduling conflicts, unforeseen circumstances, and tutor  availability. 

11.3. In the event of a Tutor change, EmPowered STEM will make reasonable efforts to inform  enrolled students and provide suitable alternatives to maintain the quality of instruction. 

  1. NO WARRANTY 

12.1. EmPowered STEM Tutors prepare courses while keeping in mind the recommended  syllabus for particular exams or educational standards. 

12.2. However, EmPowered STEM does not guarantee any specific output, results, or  performance as a result of enrolling in the course. Responsibility for the success or failure  of the efforts rests ultimately with the Student. 

  1. TECHNICAL REQUIREMENTS 

13.1. To access and participate in our courses, the Student is responsible for ensuring they have  the necessary technical requirements, including a compatible device, internet connection,  and any required software. 

13.2. The EmPowered STEM shall not be held responsible for any technical issues or  limitations that may impede the Student's access to or participation in the courses. 

  1. STUDENT CODE OF CONDUCT

14.1. Although the classroom environment is virtual (online), appropriate code of conduct  should be maintained by Student. 

14.2. The Student shall respect all other students and their parents in the course and  community. 

14.3. The Student shall address the Tutor and all staff members of the Company in a polite and  courteous manner appropriate for speaking to adults. The tone of emails and phone  conversations must be respectful. 

14.4. The Student shall further maintain a proper code of conduct as expected in a learning  environment. 

14.5. The Student shall endeavour to keep their cameras working and turned on during the  lesson, on a reasonable request of the tutor. 

  1. PRIVACY AND DATA PROTECTION 

The EmPowered STEM is committed to protecting the Student's privacy and personal  information. The EmPowered STEM's Privacy Policy explains how the Student's  information is collected, used, and disclosed. By using the Website and enrolling in the  courses, the Student agrees to the terms of the Privacy Policy. 

  1. LIMITATION OF LIABILITY 

16.1. The EmPowered STEM shall not be liable for any direct, indirect, incidental,  consequential, or special damages arising from or in connection with the Student's use of  the Website or course participation. 

16.2. The EmPowered STEM's total liability, whether in contract, warranty, tort (including  negligence) or otherwise, shall not exceed the total amount paid by the Student for the  specific course in question. 

  1. FEEDBACK AND TESTIMONIALS 

EmPowered STEM values feedback and testimonials from its students. By providing  feedback or testimonials, you grant EmPowered STEM the right to use and publish your 

feedback or testimonial, including your name and likeness, for promotional and  marketing purposes, both online and offline.  

  1. MISCELLANEOUS 

18.1. Governing Law and Jurisdiction: This Agreement is governed by and construed in  accordance with the English laws, without regard to conflict of law principles. The  London Courts will have exclusive jurisdiction to deal with any dispute arising out of or  in connection with this Agreement. 

18.2. No Assignment: This Agreement may not be assigned by either party, by operation of  law or otherwise, without the prior written approval of the other party. 

18.3. Waivers: No waiver shall be effective unless it is in writing and signed by the party  asserted to have granted such waiver. Any waiver granted shall not operate as, or be  construed to be, a waiver of any subsequent breach hereof. 

18.4. Severability: The invalidity or unenforceability of any provision of this Agreement shall  not affect the validity or enforceability of any other provision of this Agreement. 

18.5. Amendment: We reserve the right to amend these Terms as may be required, from time to time. Reasonable efforts will be made to inform the Student of any such changes, after  which time any continued use of our services will be considered to constitute acceptance  of these changes.
